DMCA Policy

1. Policy Overview

Astyris Games Studio respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond exponentially to claims of copyright infringement committed using our Services that are reported to our Designated Copyright Agent.

2. Submitting a Takedown Notice

If you are a copyright owner, or are authorised to act on behalf of one, or authorised to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated agent.

Notice Requirements

  • Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
  • Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (URL, Screenshot, or explicit description).
  • Provide your contact information: Name, Address, Telephone, and Email.
  • Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law."
  • Include the following statement: "The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorised to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  • Provide your physical or electronic signature.

4. Counter-Notice Procedure

If you believe your material was removed or disabled by mistake or misidentification, you may file a counter-notice. To be effective, the written counter-notification must cover the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, physical address, and telephone number.
  • A statement that you consent to the jurisdiction of the courts of England and Wales.

5. Repeat Infringer Policy

Astyris will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer. We reserve the right to define the criteria for "repeat infringement," but generally, this involves three valid DMCA strikes against an account within a 12-month period.
